1. Acceptance of Terms

By accessing or using ScreenGuide ("Service"), operated by ScreenGuide ("we", "us", or "our"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, you may not use the Service. These Terms constitute a legally binding agreement between you and ScreenGuide.

2. Description of Service

ScreenGuide is a web-based software-as-a-service (SaaS) platform that enables users to upload screenshots and generate step-by-step documentation using artificial intelligence. The Service includes features such as AI-powered content generation, annotation tools, export capabilities, and collaborative sharing.

3. Account Registration

To access certain features of the Service, you must create an account by providing a valid email address. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate and complete information and to notify us immediately of any unauthorized use of your account.

4. Permitted Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You shall not:

• Upload content that infringes upon intellectual property rights of third parties
• Upload content containing personal data, confidential information, or trade secrets of third parties without proper authorization
• Use the Service to generate content that is unlawful, harmful, threatening, abusive, defamatory, or otherwise objectionable
• Attempt to gain unauthorized access to the Service, other accounts, or related systems
• Use the Service in any manner that could disable, overburden, or impair the Service
• Reverse engineer, decompile, or disassemble any part of the Service
• Use automated means to access the Service without our prior written consent

5. User Content

You retain all ownership rights to the content you upload to the Service ("User Content"), including screenshots, notes, and other materials. By uploading User Content, you grant us a limited, non-exclusive license to process, store, and display your content solely for the purpose of providing the Service to you.

You are solely responsible for ensuring that your User Content does not contain sensitive personal data, confidential business information, credentials, or any material that you are not authorized to share. We strongly recommend reviewing and redacting sensitive information before uploading.

6. AI-Generated Content

The Service uses artificial intelligence to analyze uploaded screenshots and generate documentation content. AI-generated content is provided on an "as-is" basis. You acknowledge that AI-generated output may contain inaccuracies and should be reviewed before use. You are responsible for verifying the accuracy and appropriateness of all AI-generated content.

7. Third-Party Services

The Service relies on third-party service providers for certain functionality, including but not limited to artificial intelligence processing, payment processing, and cloud infrastructure. Your use of the Service is also subject to the terms and policies of these third-party providers. While our primary infrastructure is hosted in Switzerland and Germany, certain third-party services may process data in other jurisdictions, including the United States. We take appropriate measures to ensure that such transfers comply with applicable data protection laws.

8. Intellectual Property

The Service, including its design, features, code, and branding, is the intellectual property of ScreenGuide and is protected by applicable intellectual property laws. Nothing in these Terms grants you any right, title, or interest in the Service beyond the limited right to use it in accordance with these Terms.

9. Subscription and Billing

The Service offers free and paid subscription plans. Paid subscriptions are billed on a monthly basis and are processed through a third-party payment provider. By subscribing to a paid plan, you authorize us to charge your designated payment method on a recurring basis until you cancel.

You may cancel your subscription at any time. Upon cancellation, you will retain access to paid features until the end of your current billing period, after which your account will revert to the free plan. Refunds are not provided for partial billing periods.

10. Data Retention and Deletion

Content associated with free accounts is subject to automatic deletion after 7 days. Paid accounts retain content for the duration of their active subscription. Upon account deletion or subscription cancellation, we will delete your data in accordance with our Privacy Policy and applicable data protection regulations.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY OF AI-GENERATED CONTENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SCREENGUIDE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

13. Indemnification

You agree to indemnify and hold harmless ScreenGuide, its officers, directors, and employees from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of your use of the Service, your User Content, or your violation of these Terms.

14. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without cause, upon reasonable notice. You may terminate your account at any time through your account settings. Upon termination, your right to use the Service ceases immediately, and we may delete your data in accordance with our data retention policies.

15. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Switzerland, without regard to its conflict of laws provisions. Any disputes arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Switzerland. If you are a consumer in the European Union, you retain the benefit of any mandatory consumer protection provisions of the law of your country of residence.

16. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after such changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
